A great job in combining experience and statistics with strategy for providing a way of escape for modern day slave victims. Sue Mead, Knoxville, TN
Human trafficking is a global crisis-there is more
at stake than people realize. Fault does not just lie within those
individuals who enslave or subjugate them. Fault lies within everybody
who knowingly uses the products, goods, or services that are bought via
the exploitation of others. Most of us don't realize how we drive the
demand for human slavery. But, like any other commercial enterprise,
the slave labor is driven by supply and demand. Both those who supply
and demand can and should face legal consequences. Robin Sax, Former Prosecutor, Author, Victims Advocate www.robinsax.com
8 Liabilities Your Lawyer May Not Know About…
That Can Destroy You and Your Business
When you hear the words “human trafficking,” does your mind switch off? That’s not my problem. That’s got nothing to do with me or my business. That’s a mistake.
Human trafficking is the world’s fastest growing crime, and it can literally devastate you, your family, and your business.
The ugly truth is legitimate businesses are being infiltrated by human trafficking organizations at an alarming rate. Multi-national corporations and their executives as well as “Mom and Pop” businesses and their employees can be destroyed by these criminals.
If you have employees or if you subcontract work, you and your business are at risk.
Trafficking involves compelled labor or service. You probably automatically think of forced prostitution, but there are many other instances as well. People are trafficked for work in restaurants, hotel housekeeping, construction, landscaping, factories, day labor, domestic service and child care, among others.
As the old saying goes, ignorance of the law is no excuse. The Department of Justice, Department of State, Department of Labor, and other enforcement organizations place a high priority on this crime.Your company can face federal and civil liability for acts of employees or subcontractors. And you don’t even have to know about it. If you “should have known,” you can be held liable, criminally and civilly.
The result can be financial devastation for individuals and businesses. Awards in human trafficking cases have been very high. Your image and reputation can be ruined by negative publicity, and customers disappear.
You may have seen these stories in the headlines:
Sony faces negative publicity after an executive and his wife lost a civil lawsuit. They had forced a domestic servant to work 18 hour days, and the wife had assaulted her. The couple was ordered to pay $825,000. Sony fired the executive, who ultimately filed bankruptcy. (The insurance company, which had no policy in place to deny coverage to those involved in human trafficking crimes, also lost money.) Later, the couple was prosecuted in federal criminal court, and the wife was sentenced to three years in prison. Her husband was fined and sentenced to community service.
Los Angeles Times, Dept. of Justice, CNN Anderson Cooper
The Cheesecake Factory made headlines when a bartender employed in their San Antonio restaurant convinced a waitress there to sell her two young daughters for commercial sex. Because he was a predator known to law enforcement, he was arrested when he made a deal with a federal agent. Cheesecake Factory will face further negative publicity as the investigation and trial proceeds. Had they had training and policy in place, the company may have been proactive in bringing this predator to justice, receiving positive press and public accolades.
KBR, a former subsidiary of Halliburton, has been sued by a Nepalese man who says he was forced to work in a KBR warehouse in Iraq. (AFP, Aug. 27, 2008)
A Chiropractor learned his massage therapist was engaged in trafficking and prostitution when federal agents arrived at his door with guns drawn, detaining all in the office, including patients, for hours. Because the chiropractor “should have known” what was going on, he faces civil and criminal prosecution.
“Teen Trafficking,” a recent TV documentary, tells the story of two middle class American girls kidnapped in Ohio, and forced into prostitution. (It could be your kids.)
An Employee travels abroad, has sex with a minor, and faces federal prosecution upon return to the U.S. What should fellow employees do when they witness such a crime? What is your company policy?
Clearly, a “head in the sand” policy is not going to help. You and your staff need to know the eight liabilities you face every day, and you need to institute a policy and procedure that will protect your business and employees.

Slavery is not a thing of the past. Human trafficking is modern-day slavery. According to UNICEF over one million children are trafficked annually worldwide. This means that every 26 seconds another child is forced to become a sex worker or someone’s labor slave. Other human tragedies may be unavoidable, but no child should have to face this nightmare.
At Million Kids, we believe if the bad guys are harming this many children a year, then the good guys must help even more. And with the efforts of our partners and your support, we can.
Million Kids distributes designated funds to recognized agencies and activists working to prevent and eradicate human trafficking. Million Kids is a single-issue nonprofit committed to ending the human trafficking and sexual exploitation of children.
